This Privacy Policy applies to all personal information collected by Duet Advisory Pty Ltd via the website located at www.duetimmigration.com.au or directly from you (and your authorised representative) during its course of work.

What is “personal information”?

(a)   The Privacy Act 1988 (Cth) currently defines “personal information” as meaning information or an opinion about an identified individual or an individual who is reasonably identifiable:

(i)            whether the information or opinion is true or not; and

(ii)           whether the information or opinion is recorded in a material form or not.

 

(b)   If the information does not disclose your identity or enable your identity to be ascertained, it will, in most cases, not be classified as “personal information “and will not be subject to this privacy policy.

 

1.     What information do we collect?

The kind of personal information that we collect from you will depend upon how you communicate with us and how you use the website. Personal information is generally collected directly from you or your authorised representative through the use of any of our standard enquiry or assessment forms. The personal information we hold about you may include you or your company/employer and any relevant information for us to provide you with the products and services you seek. Personal information may include details such as your name, age, gender, nationality, travel history, family composition, and other contact information etc.

(a)     We may collect personal information from you whenever you input such information into the website.

(b)     We also collect cookies from your computer, which enable us to tell when you use the website and also to help customise your website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.

 

3.     Purpose, use, and disclosure of personal information

(a)   The purpose for which we collect personal information is to provide you with the best service experience possible. We will use your personal information to

(i)            Fulfil your instructions on immigration advice and services provided to you and relevant parties such as your employer and family members.

(ii)           Comply with requests from agencies

(iii)          Comply with our legal and professional obligations

(iv)          Inform you of our services, including immigration news updates, visa newsletters and any related information relevant to the services you seek.

(v)           Provide you with the best user experience by analysing collected data and, from time to time, through working with maintenance and support personnel or third-party providers in acting in the normal course of their duties.

 

(b)   We are obliged to provide information to migration-related agencies, so any restraint on providing information to an agency may mean that your immigration application may be impossible. Unless you tell us otherwise, Duet Immigration will use your personal information to provide assistance to you in relation to the immigration services you seek from us, preparation of visa application lodgement on your behalf as your registered migration agent and confirm your visa status using Visa Entitlement Verification Online (VEVO).

 

(c)   Information acquired during the engagement is subject to strict confidentiality requirements, which will not be disclosed to other parties without your express consent except as required or allowed for by law, such as being the subject of a subpoena about the information we hold.

 

(d)   Subject to the obligations under the Office of the Migration Agents Registration Authority’s Code of Conduct (‘Code’) that the registered migration agents of Duet Immigration are bound by, your personal information may be disclosed to your employer, family members, the Department of Home Affairs (DHA) and any authorised third parties in relation to processing or assessing your relevant applications.

 

(e)   The law may permit or require us to disclose your information for other purposes where you reasonably expect us to and the purpose is related to the collection purpose.

 

(f)    By using our website, you consent to the receipt of direct marketing material. We will only use your personal information for this purpose if we have collected such information directly from you. If it is material of a type, you would reasonably expect to receive it from us. We do not use sensitive personal information in direct marketing activity. Our marketing material will include a simple means by which you can request not to further communications of this nature.

If information is not collected and used, we may be unable to conduct our work for you or keep you informed of relevant events. We may contact you to offer you our services or services relevant to you arising from our work. Please advise us in writing if you do not wish that to occur.

 

4.     Access and correction

Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. 5.     Compliant procedure

If you have a complaint concerning the manner in which we maintain the Privacy of your personal information, please contact us as set out below. Privacy Officer will consider all complaints, and we may seek further information from you to clarify your concerns. If we agree that your complaint is well-founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.

 

6.     Overseas transfer

Your personal information will not be disclosed to recipients outside Australia unless you expressly request us to do so or as required in the course of our work, such as we may disclose information to persons overseas during the course of an application for immigration which relies on information sources from overseas. If you request us to transfer your personal information to an overseas recipient, the overseas recipient will not be required to comply with the Australian Privacy Principles, and we will not be liable for any mishandling of your information in such circumstances.

7.     GDPR

In some circumstances, the European Union General Data Protection Regulation (GDPR) provides additional protection to individuals located in Europe. Where this is the case, there may be additional rights and remedies available to you under the GDPR if your personal information is handled in a manner inconsistent with that law.

 

8.     Internet Data

No data transmission over the internet is completely safe and guaranteed to be fully secure. but we are required to use it by agencies. We take all reasonable efforts to use secure equipment and methods to keep your information. We recommend you take reasonable measures such as back-ups, virus prevention, using recommended sites and channels and passwords.
